Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of the QuickComp website, software, and related services (collectively, the “Services”) provided by QuickComp (“we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Description of the Services

QuickComp provides tools and content intended for real estate professionals. Features, availability, and pricing may change over time. We may modify, suspend, or discontinue any part of the Services with reasonable notice where practicable.

Accounts and eligibility

You must be an active licensed agent with SWMLS access. You may need to create an account to access certain features. You agree to provide accurate information and to keep your credentials confidential. You are responsible for activity under your account. Notify us promptly of any unauthorized use.

Acceptable use

You agree not to misuse the Services, including by attempting to gain unauthorized access, interfering with operation, scraping in violation of our policies or applicable law, uploading malicious code, or using the Services in a manner that violates law or infringes others’ rights.

Intellectual property

The Services, including software, text, graphics, logos, and branding, are owned by QuickComp or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes.

Your content

You retain ownership of content you submit to the Services. You grant us a license to use, host, and process that content as needed to provide and improve the Services.

Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific business outcomes or accuracy of outputs from automated or AI-assisted features. QuickComp outputs are estimates for informational purposes only - not a formal appraisal, not lending or investment advice, and not a substitute for a licensed appraiser or the user’s own professional judgement.

Limitation of liability

To the fullest extent permitted by law, QuickComp and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising from your use of the Services. Our aggregate liability for claims arising from the Services will not exceed the greater of (a) the amount you paid us for the Services in the twelve months before the claim or (b) one hundred U.S. dollars (USD $100), except where prohibited by law.

Indemnity

You agree to defend and indemnify QuickComp and its affiliates against claims arising from your use of the Services, your content, or your violation of these Terms, to the extent permitted by law.

Cancellations

You may cancel your subscription according to the cancellation method shown in your account or billing communications. Cancellation stops future charges; it does not automatically refund prior charges.

Termination

We may suspend or terminate access to the Services if you materially breach these Terms or if we are required to do so by law. You may stop using the Services at any time. Provisions that by their nature should survive will survive termination.

Governing law

These Terms are governed by the laws of the State of New Mexico, United States, excluding conflict-of-law rules, except where mandatory local law provides otherwise.

Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Material changes may be communicated through the Services or by email where appropriate. Continued use after the effective date of changes constitutes acceptance unless applicable law requires otherwise.
